SNOW REMOVAL CONTRACT:
**Please Read All Terms & Conditions Below Before Submitting Your Information**
ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS AND SERVICES OBTAINED PURSUANT HERE OR WITH THE PROCEEDS HEREOF, RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.ANY REFERENCE TO “THE COMPANY” IN THIS CONTRACT SHALL BE CONSTITUTED TO MEAN THE COMPANY.
TERMS: NET CHECK/CASH UNLESS OTHERWISE STATED IN AGREEMENT. THE UNDERSIGNED REPRESENTS THAT (HE IS) (SHE IS) (THEY ARE) THE (OWNER) (OWNERS) OR (RESPONSIBLE PARTY) OF THE PROPERTY DESCRIBED IN THIS CONTRACT. IT IS UNDERSTOOD THAT THE ENTIRE CONTRACT IS CONTAINED IN THIS AGREEMENT AND THAT NO OTHER AGREEMENT OR UNDERSTANDING, VERBAL OR WRITTEN, SHALL BE BINDING ON THE COMPANY, AND THAT THIS CONTRACT BECOMES EFFECTIVE ONLY UPON WRITTEN ACCEPTANCE BY THE COMPANY AFTER WHICH THIS CONTRACT IS NOT SUBJECT TO CANCELLATION. THE COMPANY RESERVES THE RIGHT TO BEGIN SNOW REMOVAL SERVICES BEFORE THE SESSION OF SNOW FALL. SNOW CLEARANCE OPERATIONS WILL BE INITIATED WHEN, IN THE BEST INTEREST AND JUDGMENT OF THE COMPANY. SNOW REMOVAL MAY REQUIRE MORE THAN ONE VISIT PER STORM. IN THE EVENT OF THE COMPANY RETURNS FOR LENGTHY STORMS, THE CUSTOMER AGREES TO PAY THE AMOUNT LISTED BELOW TIMES THE AMOUNT OF VISITS. SNOW WILL BE REMOVED FROM THE DESIGNATED AREAS AFTER REACHING A DEPTH AGREED TO BY BOTH PARTIES. SNOW CLEARANCE OPERATIONS WILL BE INITIATED WHEN, IN THE BEST JUDGMENT OF THE COMPANY, CONDITIONS ARE SUCH THAT SNOW REMOVAL OPERATIONS ARE REQUIRED. IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTING PARTY TO NOTIFY THE COMPANY IN WRITING OR PHONE 7 DAYS BEFORE CANCELLATION OF ANY SNOW REMOVAL CONTRACT. SAND, SALT, ICE MELT AND MAGNESIUM CHLORIDE MAY ALL BE USED AT THE DISCRETION OF THE COMPANY TO PROVIDE THE BEST REMOVAL OF SNOW POSSIBLE. THE COMPANY ASSUMES NO RESPONSIBILITY OF CLEAN UP OF THESE MATERIALS. THE COMPANY SHOULD NOT BE HELD LIABLE FOR ANY DAMAGES WHAT SO EVER OR FOR DELAYS IN PERFORMANCE OF THIS CONTRACT DUE TO CAUSES BEYOND ITS REASONABLE CONTROL. WORKMEN’S COMPENSATION AND PUBLIC LIABILITY INSURANCE ARE PROVIDED BUT THE COMPANY AGREES TO EXECUTE ALL NECESSARY PAPERS OR FORMS TO ENABLE THE COMPANY TO OBTAIN PAYMENT FOR EQUIPMENT, LABORER, AND MATERIALS WHICH WOULD BE INVOLVED IN PERTAINING TO THIS CONTRACT. THE COMPANY IS NOT RESPONSIBLE FOR ANY DAMAGES OCCURRED WHILE PERFORMING THIS WORK SUCH AS DRIVEWAY EDGING, PARKING CURBS, CULVERT PIPES, SEWER LIDS, SCRATCHES OR CRACKS IN CONCRETE OR ASPHALT, THE LANDSCAPING OR TRACKS MADE BY VEHICLES OR OTHER EQUIPMENT OR ANY OTHER UNSEEN OBJECTS OR LIABILITIES THAT MAY OCCUR UNLESS OTHERWISE SPECIFIED. CUSTOMER IS ENTITLED TO COPY OF CONTRACT AT THE TIME OF AFFIXING SIGNATURE.
RATES & PRICING:
The Company offers to do or arrange to have done only the items listed below at the rates listed below:
Snow Removal Service performed by means of Plows, Skid steers, Backhoes, Front End Loaders, Mechanical Motorized Snow Blowers, Hand Shovels, Salt Spreaders, Physical Labor or any other means the company feels necessary to complete the service.
A Snow Removal Crew consists of at least but not limited to one piece of Snow Removing equipment (plow, skid steer, loader, etc.) with operator and one laborer with a shovel for walkways, porches, steps, etc.
Snow Removal Rates are $220.00 per hour, per crew with a $60 minimum.
Salt and/or Sand is Billed at $65.00 per 40lb Bag and labor is included in the Snow Removal Rate. Salt and/or Sand is applied at customers approval.
Base Estimates* :
8' x 8' Driveway with 5' Sidewalk: 1"- 3" = 15 Minutes or $60.00
4" - 6" = 30 Minutes or $120.00
6" - 10" = 45 Minutes or $180.00
10" - 14" = 60 Minutes or $240.00
*Estimates Vary With Different Circumstances (Slopes, Turns, Structures, Gravel, Driveway Edging, Salt Spreading, etc.)
**LARGE JOBS SUCH AS PARKING LOTS REQUIRE AN ESTIMATE AND CANNOT USE THIS CONTRACT.
PAYMENT TERMS: Balance due on the contract the same day work is completed. A Company Representative will make arrangements to collect the balance due on the same day as the work was completed otherwise a bill will be mailed before the last day of the month work was performed and a fifteen day grace period is given to the customer by the company for the total balance due. After the fifteenth day of the following month a $40.00 late fee is added to the past due balance every 15 days the balance is past due. In the event that the account of the buyer is placed in the hands of an attorney for collection whether or not suit is filed, the buyer agrees to pay attorney’s fees in the amount of 15 per cent of the amount due together with any other suit cost or costs of collection. It is further agreed that past due amounts are subjected to 1-1/2 per cent per month service charge (18 percent per annum) and that the buyer agrees to pay a service charge of $50.00 on each dishonored check.
